1.                  Call to Order, Roll Call and Pledge of Allegiance Motion by McFadyen, seconded by Soulliere, to excuse Council members Boyle, Moffitt, and Walby.  Approved 4-0

2.                  Proclamation  & Presentations

5.                  Request from the of St. Clair Shores  to drop E A Fuller Oak Management Corporation as co-licensee and add National Coney Island Inc, as co-licensee in  2005 Class C Licensed business with Dance permit at 22185 Masonic Motion by McFadyen, seconded by Soulliere.  Approved 4-0

6.                  Request for variance to allow an additional accessory structure and a variance of 198.9 sq. ft. for total lot coverage at 30612 Champine, petitioner P. Dwaihy (Rescheduled from 7/5/05) Motion by McFadyen, seconded by Soulliere to table as petitioner was not present.  Approved 4-0

7.                  Request for a 2 ft. variance for total height for a proposed home renovation at 22651 Lakeland, petitioner G. Puck (Rescheduled from 7/5/05) (rescheduled to 8/1/05)

8.                  Request for a 1.33 ft. total height variance and 1.66 ft. wall height variance for a new garage at 25119 Culver, petitioner P. Bishop Motion by Stahl, seconded by McFadyen. Roll Call vote: Ayes-2 Nays-2 Soulliere, Hison   MOTION FAILED.

9.                  Request for variance to leave existing fence in lieu of a 6 ft. wall as required by Ordinance at 21618 9 Mile Road, petitioner G. Jayakar (Rescheduled from 7/5/05) (rescheduled to 8/1/05)

10.              Request for Site Plan Approval PC 05-16 for a proposed new commercial development on the west side of Harper between Gaukler and Alger, petitioner K Cieszkowski Motion by McFadyen, seconded by Soulliere    Approved 4-0

11.              Request for 18 ft. front yard setback variance and a variance to allow an accessory building/structure in the front yard, to be used as office space at 30512 Jefferson, petitioner D. Zeleney (rescheduled to 8/1/05)

12.              Request for a 192 total square footage variance for a proposed new garage at 21622 Evergreen, petitioner D. Conte (rescheduled to 8/1/05)

13.              Request from Jack’s Waterfront Restaurant for tent and outdoor music for Venetian Fest events August 9,10 and 11,  2005 from 7 -10:30 pm Motion by Soulliere, seconded by McFadyen.  Approved 4-0

14.              Request for a 1 ft. 8 in. total height variance for a new accessory building/structure at 28117 Elmdale, petitioner R. Heilbronn Petitioner asked to be rescheduled.  

15.              Request for a 395 sq foot total lot coverage variance for the installation of a pool at 29230 Hughes, petitioner C.Pegelo Motion by McFadyen, seconded by Stahl to TABLE for petitioner to secure letters from abutting neighbors.  Approved 4-0

a. Request to award bid for Police Building Audio/Video Surveillance System, bids opened 6/28/05  Motion by McFadyen, seconded by Soulliere.  Approved 4-0

b. Request to award bid for 2005 Local Paving Project, bids opened 7/07/05 Motion by McFadyen,           seconded by Soulliere.  Approved 4-0

c. Request to award bid for 2005 Bituminous Resurfacing Project, bids opened 7/07/05

     Motion by McFadyen, seconded by Soulliere.  Approved 4-0

d. Request to award bid for Inside St. Clair Shores newsletter, bids opened 7/05/05 (Item

    rescheduled to 8/1/05)

e. Request to enter into an agreement with the Michigan Department of Transportation (MDOT) for construction of noise abatement wall along the east side of I-94 from Stephens to Ten Mile Road and authorizing the City Manager and City Clerk to sign the agreement  Motion by McFadyen, seconded by Soulliere.  Approved 4-0

f. Approval of Blanket Purchase orders (Item rescheduled to 8/1/05)

18.              Consent Agenda – items shall be considered without debate by one motion and vote of Council, unless a member of Council specifically requests action taken separately on said item  Motion by Soulliere, seconded by McFadyen.  Approved 4-0

19.              City Manager’s Report

a.  Request to approve purchase for Police Department 800 MHZ radio equipment  Motion by Soulliere,

     seconded by  McFadyen.  Approved 4-0

b.  Request from W. Stewart to proceed with State of Use for the trademark City of Lights – St. Clair

     Shores, MI  and that the Use of the this trademark be placed on the bottom of City stationery

     Motion by Soulliere, seconded by McFadyen.  Approved 4-0
